Early Access Terms of Use for the BodyWision App.

  • 1. Provider and scope These Terms of Use apply to the use of the BodyWision mobile application during Early Access. The provider is BodyWision GmbH, Vienna, Austria. Further company information, including address and contact details, is available in the Legal Notice. BodyWision is intended for consumers for private use. Use is permitted only for persons aged 18 or older. Use by companies, medical institutions, or other organizations is permitted only under a separate agreement. Without a separate agreement, the app may not be used to provide medical, therapeutic, nursing, insurance-related, occupational health, expert assessment, or other professional services to third parties.
  • 2. Early Access / test phase BodyWision is currently in Early Access. The app is provided free of charge as an early, non-final version so that users can test core functions, gain experience, and provide feedback. Early Access may be technically, functionally, or operationally limited. This may include limits on the number or size of uploaded documents, the number of AI requests, available profiles, individual functions, types of analysis, storage periods, or support options. BodyWision may further develop, change, restrict, interrupt, or end Early Access at any time. There is no entitlement to permanent availability, specific functions, or later participation in a final product version. BodyWision reserves the right to move the app to a paid model in the future. Users will be informed separately before any paid use begins. Users will not incur costs without their active consent.
  • 3. App Stores Download, installation, and operation of the app take place via the Apple App Store or Google Play Store. The terms of the respective app store provider may apply in addition to these Terms of Use. These Terms of Use are concluded exclusively between the users and BodyWision. Apple and Google are not providers of BodyWision, are not parties to these Terms of Use, and are generally not responsible for the content, operation, support, maintenance, or services of BodyWision. Where required by Apple App Store rules, users acknowledge that Apple and Apple's affiliates may be third-party beneficiaries of these Terms of Use and may be entitled to enforce applicable provisions against users.
  • 4. Intended purpose and service description BodyWision supports users in securely storing, organizing, structuring, analyzing, and presenting personal health records in an understandable form. The app may summarize, organize, connect, and explain uploaded or entered health information on a document-based basis. It is intended to help users gain a better overview of their own records, identify relevant topics within existing documents, and prepare more informed conversations with doctors or other healthcare professionals. AI-supported processing relates to existing health records and user inputs. It is intended to support understanding, personal health documentation, and preparation for medical appointments. During Early Access, BodyWision is not intended, approved, or certified as a medical device within the meaning of the EU Medical Device Regulation (MDR). The app is not intended for diagnostic or therapeutic purposes. The specific scope of functions may change during Early Access.
  • 5. No medical service BodyWision does not replace medical advice, examination, diagnosis, or treatment. The app does not provide a medical service and must not be understood as a substitute for personal assessment by qualified doctors or other appropriate healthcare professionals. In particular, BodyWision is not intended to independently make diagnoses, medically assess symptoms, determine medical urgency, make specific treatment decisions, recommend medication, dosages, or treatments, or assess or rule out emergencies. Medically relevant questions, decisions, or actions must be evaluated together with qualified doctors or other appropriate healthcare professionals. Questions concerning medication, dosages, interactions, side effects, or changes to medication use must be clarified exclusively with doctors or pharmacists. BodyWision must not be used to change, discontinue, or select medication.
  • 6. AI functions, analysis, and topic prioritization BodyWision may use AI functions to analyze, structure, summarize, and explain health records in a more understandable way. AI-generated content may be incomplete, misleading, outdated, or incorrect despite careful technical design. AI systems may generate content that appears plausible or persuasive but is factually incorrect, incomplete, taken out of context, or not supported by the underlying documents. Such errors may occur in particular with medical terminology, laboratory values, timelines, medication, translations, or relationships between multiple documents. To the extent BodyWision displays topics, priorities, document-related assessments, or indicators, these relate exclusively to the available records and entered data. They are document-based orientation aids, for example based on frequency, recency, context, document type, or relevance within the available records. Such priorities and indicators do not assess the user's actual health condition. They are not a medical score, disease risk, urgency assessment, diagnosis, or recommendation to take or refrain from any specific medical action. Information from BodyWision is intended to support understanding and preparation for medical appointments. It must not be used as the sole basis for medical decisions.
  • 7. Diagnoses, guidance, and next steps Diagnoses are stored, displayed, or structured in BodyWision only if they come from uploaded medical documents or are entered by users themselves. BodyWision does not create its own medical diagnosis from this information. Guidance, possible next steps, or recommendations in the app are intended only to support understanding and orientation. These may include questions for a medical appointment, prompts to discuss a topic with a doctor, organizational suggestions, or general information on lifestyle and personal health organization. Such content is not a binding medical instruction or course of action. Users must review medically relevant guidance and seek medical clarification in case of uncertainty.
  • 8. Emergencies BodyWision is not intended for medical emergencies and cannot identify or rule out acute risks. In the event of acute, severe, or worsening symptoms, suspected emergencies, or uncertainty, users must immediately contact medical help, an on-call medical service, or emergency services. Users must not wait for app guidance or output in such situations.
  • 9. Family profiles and third-party data Minors may not create their own account and may not use BodyWision themselves. Health data of minor children may only be managed by adults with parental responsibility or legal authority within a family profile. Users may upload or manage health data of other persons only if they are authorized to do so, in particular on the basis of consent, parental responsibility, legal representation, or comparable legal authority. Users are responsible for ensuring that their use of BodyWision for other persons is lawful and that affected persons have been appropriately informed where required.
  • 10. User obligations Users agree to upload only lawfully available documents and data, not to process third-party health data without authorization, not to enter false, misleading, or unlawful content, to protect access credentials, devices, and app access against unauthorized access, to report any suspected unauthorized access without undue delay, not to use BodyWision in an abusive, unlawful, or security-threatening manner, not to circumvent technical protection measures, to critically review AI-generated content, and to seek medical clarification for medically relevant topics. Users are responsible for ensuring that uploaded or entered information is complete, current, and suitable for the respective purpose. BodyWision cannot reliably detect or correct incomplete, inaccurate, or contradictory source data.
  • 11. Rights to uploaded content Users retain all rights to their uploaded documents and entered data. Users grant BodyWision only those rights that are necessary to provide the app functions. This includes, in particular, storage, processing, technical analysis, display, structuring, summarization, and AI-supported processing within the app. These rights serve exclusively to provide and improve the agreed app functions and to ensure the security and stability of the service, to the extent permitted under the Privacy Policy.
  • 12. Support During Early Access, BodyWision provides technical support through the designated support channels. The scope, response times, and availability of support may vary during the test phase. No medical advice is provided via support, email, WhatsApp, or comparable communication channels. Users should not submit medical documents or sensitive health information through these channels unless BodyWision expressly provides a secure channel intended for this purpose. Unlawful content, misuse, or security issues may be reported through the contact address stated in the Legal Notice.
  • 13. Availability, warranty, updates, and changes BodyWision strives to provide stable and secure operation, but during Early Access does not guarantee any specific availability, freedom from errors, or permanent provision of individual functions, to the extent permitted by law. Functions may be changed, expanded, restricted, or removed during the test phase. This applies in particular to AI functions, analyses, usage limits, profiles, displays, export functions, and support options. To use the app, users need a compatible device, a supported operating system, internet access, and access to the relevant app store. BodyWision may provide updates required for security, stability, further development, compatibility, or legal requirements. Users should install such updates promptly in order to use the app properly. Statutory warranty rights remain unaffected.
  • 14. Termination of use Users may stop using BodyWision at any time. BodyWision may restrict or terminate access if users violate these Terms, if security risks arise, if unlawful use is suspected, or if Early Access is ended. This applies in particular in cases of misuse, unauthorized processing of third-party health data, circumvention of technical protection measures, automated access, security attacks, infringement of third-party rights, or any other use that endangers BodyWision, other users, or the integrity of the service. To the extent users have a right to data export or deletion, this is governed by the Privacy Policy and applicable legal provisions.
  • 15. Rights to the app and feedback All rights to BodyWision, including software, design, trademarks, texts, data models, concepts, and other protected content, remain with BodyWision or the respective rights holders. Users receive a personal, non-exclusive, non-transferable, revocable right to use the app solely for private purposes within the scope of these Terms. BodyWision may use feedback, ideas, or suggestions for further development, improvement, and commercial use of the app. Personal data will be processed only in accordance with the Privacy Policy.
  • 16. Privacy Information on the processing of personal data, in particular health data, as well as on consent, withdrawal, deletion, export, and data subject rights, is provided in the Privacy Policy. The use of core health-related functions requires explicit consent to the processing of health data. Without such consent, certain functions may not be available or may be available only in a limited form.
  • 17. Liability BodyWision is provided during Early Access free of charge and as a non-final test version. Users use the app voluntarily for testing and evaluation. BodyWision is liable in accordance with statutory provisions. To the extent permitted by law, BodyWision assumes no liability that AI-generated content is correct, complete, current, or suitable for any particular medical purpose. Users remain responsible for reviewing medically relevant information and coordinating decisions with qualified doctors or other appropriate healthcare professionals. To the extent permitted by law, BodyWision assumes no liability in particular for consequences arising from incorrect recognition, extraction, structuring, interpretation, summarization, translation, or presentation of documents, from incomplete or delayed guidance, from technical interruptions, from data loss outside BodyWision's sphere of responsibility, or from decisions made by users on the basis of the app without medical clarification.
  • 18. Changes to these Terms BodyWision may amend these Terms of Use, in particular in the event of changes to the app, Early Access, technical functions, legal requirements, or a later business model. Material changes will be communicated in the app or by other appropriate means. Where required, renewed consent will be obtained. Without required consent, further use of individual functions or of the app as a whole may be restricted.
  • 19. Applicable law Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer rights of the country in which users have their habitual residence remain unaffected.
  • 20. Final provisions If individual provisions of these Terms of Use are or become invalid, the validity of the remaining provisions remains unaffected. For questions about these Terms of Use, BodyWision can be contacted via the contact address stated in the Legal Notice.
